1. Introduction
1.1. These Terms and Conditions (“Terms”) govern your access to and use of the website www.houseofcaia.com (“Website”), operated by Kanex Tekstil Müm. Tic. ve San. A.Ş. (“House of Caia”, “we”, “us”, or “our”).
1.2. By accessing or using the Website, you agree to be bound by these Terms. If you do not accept these Terms, you must refrain from using the Website.
1.3. We reserve the right to amend these Terms at any time. Any changes will take effect upon publication on the Website.
2. Definitions
• Buyer / Customer / You: Any natural or legal person accessing the Website or placing an order.
• Seller / We / Us: Kanex Tekstil Müm. Tic. ve San. A.Ş.
• Product(s): Goods offered for sale on the Website.
• Order: The electronic purchase request submitted by the Buyer.
3. Use of the Website
3.1. You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of others.

4.2. Colours and textures may vary depending on screen settings; such variations do not constitute a defect.
4.3. We reserve the right to modify or discontinue any product at any time.
5. Ordering and Contract Formation
5.1. By placing an order, you confirm that all information provided is accurate and complete.
5.2. An order constitutes an offer to purchase. Acceptance occurs only when we issue an order confirmation email.
5.3. We reserve the right to refuse or cancel any order, including where:
• Payment is not authorised
• Stock is unavailable
• Fraud or misuse is suspected
6. Pricing and Payment
6.1. All prices displayed on the Website include applicable taxes unless stated otherwise.
6.2. Payment may be made via credit card, debit card, or approved online payment systems.
6.3. House of Caia does not store or retain card information.
6.4. If payment is declined, the order will not be processed.
7. Delivery
7.1. Products will be dispatched to the courier within 3–7 business days following order confirmation, unless otherwise stated.
7.2. Delivery times may vary depending on the Buyer’s location and courier operations.
7.3. Risk in the Products passes to the Buyer upon delivery to the address provided.
7.4. If the Buyer is not present at the delivery address, delivery will proceed in accordance with the courier’s procedures.
8. Right of Withdrawal (Cooling‑Off Period)
8.1. The Buyer may exercise the statutory right of withdrawal within 14 days from the date of delivery, without providing any reason.
8.2. The right of withdrawal does not apply to:
• Custom‑made or personalised products
• Products unsuitable for return due to hygiene reasons where packaging/tags have been opened (e.g., bedding, pillowcases, duvet covers, special textiles)
• Products that have been used, damaged, or rendered unfit for resale
8.3. To exercise the right of withdrawal, the Buyer may:

8.4. Returned products must be unused and accompanied by the original invoice.
8.5. Refunds will be processed within 14 days of receipt of the returned product, using the original payment method.
9. Defective or Faulty Products
9.1. If a product is defective, the Buyer may exercise one of the following rights under applicable consumer law:
• Free repair
• Replacement with a non‑defective equivalent
• Price reduction
• Refund and termination of the contract
9.2. Claims relating to defective products must be submitted within 30 days of delivery.
10. Intellectual Property
10.1. All content on the Website—including text, images, logos, designs, and trademarks—is the property of House of Caia or its licensors.
10.2. You may not reproduce, distribute, modify, or use any content without prior written consent.
11. Personal Data and Privacy
11.1. Personal data is processed in accordance with the House of Caia KVKK Information Notice.
11.2. SSL encryption is used to protect payment information.
11.3. By using the Website, you consent to the processing of your personal data as described in our Privacy Notice.
12. Force Majeure
12.1. We shall not be liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, strikes, courier disruptions, or technical failures.
12.2. In such circumstances, we will notify the Buyer and take reasonable steps to minimise disruption.
13. Limitation of Liability
13.1. Nothing in these Terms shall limit liability where such limitation is prohibited by law.
13.2. Subject to mandatory consumer protections, we shall not be liable for:
• Indirect or consequential losses
• Loss of profit, revenue, or business
• Delays caused by third‑party courier services
14. Governing Law and Jurisdiction
14.1. These Terms shall be governed by the laws applicable in the Republic of Türkiye.
14.2. Consumer disputes shall be resolved by the Consumer Arbitration Committees or Consumer Courts located in the Buyer’s place of residence or where the Seller is located.
15. Severability
15.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
16.1. These Terms, together with the Distance Sales Agreement and Privacy Notice, constitute the entire agreement between the Parties regarding the use of the Website.
