Distance Sales Agreement

This Distance Selling Agreement has been concluded electronically in accordance with the provisions of the Law No. 6502 on Consumer Protection ("TKHK") and the Regulation on Distance Contracts .

By confirming the order, the buyer is deemed to have accepted all the terms and conditions of this agreement.

TOPIC 2

This agreement concerns the sale and delivery of products ordered by the BUYER electronically through the website www.houseofcaia.com, and the definition of the rights and obligations of the parties in relation to this transaction.

3. PRODUCT INFORMATION

The following information is presented to the BUYER on the order screen and becomes an integral part of the contract upon order confirmation:

  • Product type, model, color, size, quantity
  • Sales price and taxes
  • Shipping and delivery information
  • Total order amount

The buyer acknowledges that they have viewed and approved all of this information before making a payment and confirming the order.

4. DELIVERY CONDITIONS

  • The product(s) will be handed over to the courier by the BUYER within 3–7 business days after order confirmation.
  • The BUYER will be informed in case of force majeure or logistical delays.
  • Delivery times may vary depending on the recipient's location.
  • If the BUYER is not present at the address, delivery will be made in accordance with the procedures of the shipping company.

5. PAYMENT TERMS

  • Payment can be made via credit card, debit card, or online payment infrastructure.
  • House of Caia does not store the BUYER's card information in any way.
  • The order will not be processed unless payment is confirmed.

6. RIGHT OF WITHDRAWAL

6.1. Legal Right of Withdrawal

The BUYER may exercise their right of withdrawal within 14 days of receiving the product, without giving any reason and without paying any penalty.

6.2. Situations Where the Right of Withdrawal Does Not Apply

The following products are exempt from the right of withdrawal:

  • Products manufactured specifically for the BUYER according to their requests.
  • Due to hygiene reasons, returns are not accepted for subcategory products (bed sheets, pillowcases, duvet covers, special textiles, etc.) if the packaging/label has been opened.
  • Used products, with tags removed, that are no longer suitable for resale.

6.3. Cancellation Notice

For the BUYER's cancellation notification:

  • You can send an email to info@houseofcaia.com
  • You can create a request from the My Account > Orders screen.

6.4. Return Process

  • The product must be returned unused and with its invoice.
  • Once the product returned under the right of withdrawal reaches the seller, the payment will be refunded within 14 days via the payment method used by the BUYER.
  • Shipping costs may vary depending on the campaign and delivery conditions.

7. DEFECTIVE PRODUCTS

In case of a defective product, the BUYER may exercise one of the following rights under Law No. 6502:

  • Free repair of the product.
  • Replacement of the product with no defects.
  • Discount on the price.
  • Termination (return) of contract

Claims regarding defective products must be made within 30 days of product delivery.

8. USER INFORMATION AND PRIVACY

The BUYER's personal data is processed in accordance with the House of Caia GDPR Privacy Policy .
An SSL certificate is used to ensure the security of credit card information.

9. FORCE MAJEURE

Delivery times may be extended in unforeseen circumstances such as natural disasters, war, terrorism, fire, strikes, cargo problems, and technical malfunctions.
The SELLER cannot be held responsible in these situations, but the BUYER will be informed.

10. DISPUTES

In consumer disputes, the Consumer Arbitration Boards and Consumer Courts located in the BUYER's place of residence or the SELLER's place of residence have jurisdiction.

11. EFFECTIVE DATE

By placing an order online, the BUYER accepts all the terms and conditions of this agreement. This agreement is concluded electronically and does not require separate signatures from the parties.
